1. Operator and acceptance of these Terms
These Terms of Use (“Terms”) govern access to and use of HerbalistAI, including its website, AI-powered chat, educational content, account features and paid subscription services (together, the “Service”).

By creating an account, purchasing a subscription or using a part of the Service for which acceptance is required, you agree to these Terms. If you do not agree, do not use the relevant part of the Service. You must be at least 18 years old to create an account or purchase a subscription.
2. Nature and purpose of HerbalistAI
HerbalistAI is an AI-powered educational wellness, health and fitness information service. It is designed to make information about herbs and their uses, traditional and documented herbal knowledge, folk recipes and general healthy-lifestyle topics easier and faster to find and understand. Information may be collected, organised, retrieved and summarised from multiple sources, including publicly accessible sources.

• Historical descriptions of herbal preparations and folk recipes.
• General educational information about wellness and healthy-lifestyle practices.
• References to source material and explanations of the information available in those sources.
• Warnings about documented hazards, contraindications and potential interactions where such information is available.
• AI-generated summaries and explanations of retrieved educational material.
HerbalistAI is not a medical service or healthcare provider. It does not diagnose diseases, provide professional medical advice or individual medical recommendations, prescribe or create treatment plans, or replace examination, diagnosis or treatment by a qualified healthcare professional. The Service does not sell herbs, herbal products, medicines or medical treatments.
3. Health and safety notice
All information is provided for general educational and informational purposes. It is not intended to determine whether a particular herb, preparation, diet or lifestyle practice is appropriate for your individual medical circumstances.
Herbs and herbal preparations may have side effects, contraindications, variable concentrations, contamination risks and interactions with medicines or other substances. Natural origin does not establish safety. Historical or traditional use does not establish that a preparation is effective or safe, and historical sources may not reflect current medical knowledge or safety standards.
The Service may identify a safety concern or indicate that available information is incomplete or has not been independently verified. The absence of a warning must not be interpreted as confirmation that an herb or preparation is safe.
Seek advice from a qualified healthcare professional before using herbs or herbal preparations where there may be a risk, particularly if you are pregnant or breastfeeding, considering use for a child, taking prescription medicines, have a serious or chronic condition, or experience symptoms requiring medical assessment. 4. AI-generated information and sources
HerbalistAI uses artificial intelligence to generate responses based on retrieved source material and other information made available to the system. AI-generated content can contain errors, omissions, outdated information, incorrect interpretations or incomplete safety information.
Citations and references are provided to help identify source material; they do not independently verify every statement in an answer. A description of traditional or historical use is not a current medical recommendation. If available sources do not adequately support an answer, the Service may indicate that the information is insufficient. An answer should not be assumed complete merely because it is presented by the Service.
You are responsible for evaluating information obtained through the Service and seeking professional advice when appropriate. The Service is an informational aid, not a substitute for your own judgment or professional assessment.
5. Account registration and security
Some features require an account. Registration requires the information requested in the registration process, which may include an email address and password.

• Keep your credentials confidential and take reasonable steps to protect your account.
• Notify us promptly if you suspect unauthorised access.
• Do not share or transfer your account except where the Service expressly permits it.

6. Subscriptions, prices and payment
6.1 Paid access
There is no free AI-chat plan. An active paid subscription is required to use the AI chat functionality. The public website, landing page, registration process and other features may be available without a subscription. Feature availability may depend on the plan purchased.

The checkout page will display the applicable price, billing interval, taxes, included features and any plan limits before purchase. The pricing page and checkout description applicable at the time of purchase form part of the purchase information.
6.3 Payment provider and seller
Payments and subscription transactions are processed through the payment provider and checkout arrangement identified at the time of purchase (“Payment Provider”). The Payment Provider may act as merchant of record or seller of record and may handle payment processing, tax calculation, invoices, renewals, refunds and payment-related customer support, depending on the arrangement actually used.
The legal seller for a particular transaction, the applicable purchase terms and the allocation of responsibilities will be identified in the checkout flow and/or the Payment Provider’s customer-facing terms. The operator’s use of a Payment Provider does not remove obligations that applicable law places directly on the operator.
You must provide accurate billing information and authorise charges for the selected subscription. Complete payment-card details are intended to be handled by the Payment Provider rather than stored in the HerbalistAI application, unless the checkout or privacy notice expressly states otherwise.
6.4 Recurring billing
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal takes effect, subject to the terms displayed at checkout. By purchasing a recurring subscription, you authorise charges at the disclosed price and billing interval. Any material price change will be communicated in accordance with applicable law and the relevant subscription terms.
6.5 Cancellation and access
You may cancel a subscription using the subscription-management functionality or the Payment Provider’s customer-support or cancellation process identified at checkout. Cancellation stops future automatic renewals. Unless applicable law or the applicable purchase terms require otherwise, access to paid features continues until the end of the already-paid billing period. Cancellation does not, by itself, refund a payment already made for that period.
Account deletion and subscription cancellation are separate actions. Deleting your HerbalistAI account does not necessarily cancel a subscription. You should separately verify cancellation through the subscription-management process unless it expressly confirms that account deletion also cancels the subscription.
6.6 Refunds and mandatory consumer rights
Refund requests are handled under the Refund Policy and the purchase terms applicable to the transaction. Nothing in these Terms or the Refund Policy excludes or restricts a withdrawal, refund, conformity, cancellation or other consumer right that cannot lawfully be excluded.
Depending on your location, the product purchased and the checkout arrangements, statutory withdrawal rights may apply to online purchases. Special rules may apply when digital content or digital services are supplied immediately. Any legally required disclosures, express requests or acknowledgements must be presented through the relevant checkout process. Acceptance of these Terms alone does not waive statutory consumer rights.
7. Availability and technical requirements
The Service requires a compatible device, internet connection and supported browser. We may maintain, update or change technical components and may temporarily suspend features for maintenance, security or operational reasons. We will take reasonable steps to maintain availability but do not guarantee uninterrupted or error-free operation. AI responses may be delayed or unavailable because of technical failures, capacity limits or external-provider outages. Mandatory statutory rights and applicable remedies remain unaffected.
8. Acceptable use
You must use the Service lawfully and must not:
• Use the Service for unlawful, fraudulent or harmful purposes.
• Attempt unauthorised access to accounts, systems, databases or another user’s information.
• Interfere with the security, integrity or operation of the Service or introduce malicious code.
• Circumvent subscription requirements or legitimate access controls.
• Copy, reverse engineer or commercially exploit the Service except where permitted by applicable law.
• Use the Service to create or distribute unlawful content or infringe third-party rights.
• Submit information or files that you are not legally entitled to provide.
• Use the Service as an emergency service or as a substitute for urgent professional medical care.
We may investigate suspected misuse and take proportionate measures reasonably necessary to protect users, the Service or third parties, subject to applicable law.
9. Intellectual property and source material
Subject to third-party rights and applicable law, the Service’s software, design, branding, interface and original content are owned by or licensed to the operator. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your personal, lawful, non-commercial purposes while you are authorised to access it.

Do not submit personal information that is unnecessary for your use of the Service, or another person’s medical or identifying information unless you have a lawful basis and the Service supports the intended use.
11. Suspension and termination
You may stop using the Service at any time and may request account deletion through the available settings or support process. We may suspend or terminate access where reasonably necessary due to a material breach, unlawful or fraudulent activity, a security threat, non-payment, a legal requirement or discontinuation of the Service. Where appropriate and legally permissible, we will provide notice and an opportunity to address the issue.
Suspension or termination does not remove rights or obligations that have already arisen, including statutory refund rights, payment obligations or consumer protections.
12. Disclaimers and liability
To the extent permitted by applicable law, the Service is provided for educational and informational purposes. We do not warrant that every AI-generated answer will be accurate, complete, current or suitable for your circumstances, or that any herb, preparation or lifestyle practice will achieve a particular result.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability that cannot lawfully be excluded for death or personal injury, fraud, wilful misconduct or other non-excludable matters. Nothing in these Terms limits mandatory consumer rights or remedies.
Subject to those restrictions, the operator is not responsible for a loss arising solely because a user chooses to rely on AI-generated educational content as a substitute for professional medical assessment or treatment. Any limitation applies only to the extent permitted by the law applicable to the user and transaction.
13. Changes to the Service and these Terms
We may update the Service and these Terms to reflect changes in functionality, security, law or business operations. Where a change materially affects your rights or obligations, we will provide notice as required by applicable law. Changes will not retrospectively remove statutory rights or remedies that have already arisen.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Serbia, without prejudice to mandatory consumer-protection rules that apply to you. Nothing in this choice deprives a consumer of protections or the right to bring proceedings before a court where mandatory applicable law provides that right.
